Updates on the Case of Luke Fairweather Murder Case: Cape Town is Paying for the Legal Representation of Ian Sinclair,

Cape Town is paying for the legal representation of Ian Sinclair, the veteran traffic officer charged with murder after the shooting of a Cape Town cricket official outside Sahara Park Newlands last week.

Kylie Hatton, spokesperson for the city, said the city had also – as part of its standard employee assistance programme – offered Sinclair, 59, trauma counselling, which he had accepted.

Both measures were provided for by council policy as the incident happened during the course of the traffic officer’s work, she said yesterday.

“To have gone through a situation like that, regardless of what happened, is a very traumatic experience,” Hatton said.

The incident – which threw the Western Province cricket fraternity into “deep shock” – occurred in Mariendahl Avenue outside Sahara Park Newlands stadium, during the Test match between South Africa and India.

The victim, Luke Fairweather, 49, allegedly pushed Sinclair’s head against a car in a scuffle that erupted after the traffic officer issued a fine to Fairweather’s mother, who’d come to fetch him.

Sinclair then allegedly drew his service pistol and fired a shot at Fairweather, hitting him in the stomach.

He was subsequently charged with murder and appeared in the Wynberg Magistrate’s Court last week, represented by a city-appointed laywer, John Riley, Hatton said.

The state did not oppose bail. The New Age understands that the R1000 bail was paid for by a colleague of Sinclair, who was eager to see the long-serving traffic officer released from prison.

His next court appearance would be on March 23, said Hatton, adding that that Sinclair had been booked off on sick leave until “his health has improved”. Police meanwhile continue with their investigations.

The provincial director of public prosecutions will then decide either to pursue a murder charge or change it to culpable homicide.

Fairweather was an official of Alma Marist Cricket Club and had been a guest in the President’s suite at Sahara Park Newlands, the WP Cricket Association said.

Several media reports of the incident have played on Fairweather’s profile on Facebook. Fairweather apparently described himself as an “ultra rightwing conservative” on the cyber network.
